WHAT IS ANNULMENT AND HOW IT IS DIFFERENT FROM DIVORCE?

The reason I have chosen this topic today is because, many a times there is a confusion regarding Divorce and Annulment, as people often think they are one and the same, whereas, in reality they are two different legal aspects. 

What is the difference between Divorce and Annulment?
 The biggest difference between a Divorce and an Annulment is that Divorce is sought for a legally valid marriage.

While an Annulment formally declares a marriage to have been legally invalid or a situation wherein person was never married, it is considered as marriage is null and void or legally invalid marriage.

When marriage is solemnized under false promises or either of spouse is physically unfit or mentally unwell or having Criminal Background or either of one spouse is below the age of majority or either of the spouse is already married to another person, and which was not disclosed to the other spouse before marriage. Under all these circumstances either husband or wife within one year of the marriage, the aggrieved person may file Petition under section 12 of Hindu Marriage Act for Annulment of marriage.
